INDIAN MOTORCYCLE NEW ZEALAND “CHALLENGER CHALLENGE” TERMS AND CONDITION


To promote the launch of the new Indian Challenger motorbike, Polaris Sales Australia Pty Ltd NZBN 9429037538347 of 33c Echelon Place, East Tamaki, Auckland 2013, trading as Indian Motor Cycle New Zealand (“Indian Motorcycle”) is conducting a promotion (the “Challenger Challenge”) on the terms and conditions below.


1.By entering and participating in the Challenger Challenge, entrants are deemed to have read, understood and accepted these terms and conditions.


2.The Challenger Challenge commences at 9:00am NZT on 1 July 2020 and finishes at 5.00pm NZT on 30 September 2020 (the “Promotion Period”).


3.To be eligible to enter the Challenger Challenge, entrants must:

a.be aged 18 years or over;

b.hold a current and valid New Zealand motorcycle license; and

c.comply with these terms and conditions.

(each an “Eligible Entrant”)


4.Eligible Entrants who complete and satisfy all of the following requirements set out at 4(a)-(d) in New Zealand during the Promotion Period to constitute a Completed Entry (as defined below) will, subject to these terms and conditions, be sent NZD$500 via bank transfer within 30 days of the completed entry form being submitted:

a.Test ride a 2020 “Indian Challenger” motorbike at a participating Indian Motorcycle dealership (please contact your dealership first to ensure they are a participating dealership and have a 2020 “Indian Challenger” motorbike available to test ride); and

b.Test ride, then purchase, a new 2020 Harley-Davidson ® Road Glide ® Special motorbike from a New Zealand dealership at the full retail price after the date the Eligible Entrant test rode the 2020 “Indian Challenger”; and

c.Take possession of the 2020 Harley-Davidson ® Road Glide ® Special motorbike purchased in accordance with 4(b); and

d.Visit a participating Indian Motorcycle dealership and complete the entry form provided for the Challenger Challenge, including the following information and documentation:

i.evidence of the Eligible Entrant’s test ride of a 2020 “Indian Challenger” during the Promotion Period (including the date, dealership name and location of the test ride);

ii.the original contract of sale and a copy of the original signed contract of sale of the new 2020 Harley-Davidson ® Road Glide ® Special motorbike as evidence of the purchase during the Promotion Period. The relevant contract for sale must be in the Eligible Entrant’s name (being the same named individual as the Eligible Entrant who test drove the 2020 “Indian Challenger” motorbike in accordance with 4(a)). For the contract for sale to be eligible, the 2020 Harley-Davidson ® Road Glide ® Special must be delivered to the Eligible Entrant during the Promotion Period. Any purchases which are delivered to the Eligible Entrant outside of the Promotion Period do not qualify as an eligible contract for sale for the purpose of the Challenger Challenge;

iii.the Eligible Entrant’s contact details, including full name, phone number, email address and postal address; and

iv.the Eligible Entrant’s New Zealand bank account details, including the relevant branch and account numbers


5.Indian Motorcycle will review all completed entry forms provided by its participating Indian Motorcycle dealership(s) to validate that each entry has been completed by an Eligible Entrant and that all requirements (referred to above at clause 4 and as otherwise set out in these terms and conditions) have been satisfied (each a “Completed Entry”). Indian Motorcycle may contact any Eligible Entrant to verify any information. In respect of each Completed Entry, Indian Motorcycle will process the transfer of NZD$500 to the nominated New Zealand bank account of the Eligible Entrant.


6.Each Eligible Entrant will only be entitled to one NZD$500 payment, even if they purchase more than one new 2020 Harley-Davidson ® Road Glide ® Special motorbike during the Promotion Period.


7.Indian Motorcycle will only make a transfer to a New Zealand bank account. Indian Motorcycle is not liable for any transfer fees or other deductions that may be made by any bank in respect of any transfer, and is not liable for any tax payable in respect of any payments made to any Eligible Entrant in accordance with the Challenger Challenge and these terms and conditions.


8.Entries received by Indian Motorcycle outside the Promotion Period (irrespective of when they were sent) will not be eligible to receive the NZD$500 payment.


9.Indian Motorcycle takes no responsibility for and shall have no obligations in respect of any late, lost, incomplete, inaudible, indecipherable or incorrectly submitted, illegible, misdirected or invalid entries, delays or failures in any equipment or telecommunications service used to administer the Challenger Challenge.


10.Indian Motorcycle may, in its absolute discretion, declare an Eligible Entrant’s entry invalid, or disqualify any Eligible Entrant where that entrant tampers with the entry process, submits an entry that is incomplete or not in accordance with these terms and conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of the Challenger Challenge.


11.Indian Motorcycle reserves the right to require an entrant to verify the validity of their entry within a requested time, including but not limited to an entrant’s identity, eligibility, age, address and compliance with the entry requirements above, and to disqualify any entrant who does not satisfy any entry criteria in these terms and conditions. If there is a dispute as to the identity of an Eligible Entrant, Indian Motorcycle reserves the right, in its sole discretion, to determine the identity of the entrant. Errors and omissions may be accepted at Indian Motorcycle’s sole discretion. Proof considered suitable for verification is at Indian Motorcycle’s discretion.


12.If for any reason the Challenger Challenge is not capable of running as planned, or is interfered with or disrupted in any way (including but not limited to, by vandalism, power failures, natural disasters, acts of God, weather events, civil unrest, strikes, computer bugs or viruses, tampering or technical failures, disease or pandemic, any government directive, or any changes whatsoever made by Harley-Davidson ® in relation to their motorcycles), Indian Motorcycle reserves the right to cancel, terminate, modify or suspend the Challenger Challenge. In the event of any termination, modification and/or suspension of the Challenger Challenge, Indian Motorcycle will notify all Eligible Entrants who have submitted an entry.


13.All of Indian Motorcycle's decisions in relation to all aspects of the Challenger Challenge are final.


14.The Challenger Challenge is in no way endorsed or associated with Facebook, Twitter, Instagram, Woobox or any other such platform used to promote it.


15.The collection of personal information in relation to the Challenger Challenge by or on behalf of Indian Motorcycle through its participating authorised dealerships is to enable the management, administration and promotion of the Challenger Challenge. Indian Motorcycle will collect and/or use personal information about entrants in its business functions and activities and for the purposes detailed in and anticipated by these terms and conditions. By participating in the Challenger Challenge, entrants consent to the collection, use and disclosure of personal information in accordance with these terms and conditions and Indian Motorcycle’s Privacy Policy, which is available at https://www.indianmotorcycles.co.nz/privacy-policy/.


16.Where you have provided consent, Indian Motorcycle and our related companies (“we”/”us”) may communicate with you from time to time about news, offers, products and services you might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). We may share your personal information with third parties who provide services to us including in relation to data matching, trending or analytical services, as well as general marketing services. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance.

17.If an entrant does not provide the information (including personal information) that Indian Motorcycle requests, we may not be able to provide entry into the Challenger Challenge. All personal information is handled in accordance with these terms and conditions and our privacy policy.
